Is my pay LEGALOkay, heres the deal. I manage a weight loss center and I get paid $38.10 a DAY !!!! I work from 8:45 AM until approx 8 PM Mon - Fri with every other Saturday off. On the Saturdays I do work, I work 745 AM until 2PM. Still at $38.10 a Day. I also get paid COMMISSION, on top of the "silly" $ 38.10 a day. When I get my pay check, it reads I worked " 11 hours at $38.10 a day". I actually work about 60 hours a week, or, 120 hours per pay period...NOT 11 ! I also, have to "punch in & out with a fancy lazer fingerprinting system every day". So, I am "full-time salary" but still have to punch in & out. I work in Minnesota and have now been with this company for over a year. I have never gotten any raise. When I spoke with my "boss" about this, I was told, to earn a raise, I can earn more money if I sell more, than I will get more commission.

It appears the $38.10 is salary which is below minimum wage based on your information. The answer to your question is NO, it's not legal (question to you, is this on the level?).
Unless my math is faulty, you're being paid less than $4 bucks an hour, regardless of how you do the calculations. It would seem to me that your employer is required to pay you at least the federal minimum wage as a full-time employee. Why don't you call you state Department of Labor office and ask them about your situation? The other thing that seems a little odd is why you'd have stayed there a year making such a small amount of money - unless the job only requires you that stand around flexing most of the time... Paul W. Barada The Negotiation Expert Your pay might be legal. Are you really their full time employee or are you some sort of independant contractor? Also, are you a commission only employee that receives a small amount of "draw" against your commission (the "salary" on your check)? Here's the bigger question- If you don't want to do sales and get paid commission, then why are you in this job? Legal or not, you boss isn't going to start paying you $20 an hour tomorrow. If you want a job that will do that, you need to go find one. That might mean you need more training in something to be more marketable, that might mean you have to really hunt to find something.. who knows?

Thanks for your input. As far as this being "on the level" I don't know. Thats why I am posting the Q here. Meanwhile I am looking around. I absolutely love what I do, but I dont like working nearly 75 hours a week 6 days a week :(

Meanwhile, the reason I stayed with them for a year, is that 1. I love what I do and 2. I assumed I would be getting a raise. I just learned recently that they "don't give raises" I am a full time employee. I clock in and out every day at work. I have set times I have to be there (a schedule) and if I clock in late, I lose any chances of getting a bonus on my paycheck for that week. Yet I still only get paid $38.10 a day whether I work a 1/2 day (I get two of those a month) or a full day (which would be 845 AM until as late as 10pm)
I am not commission only. I get paid $38. 10 a day and then 1% of my own personal sales and 5% of what the entire center does. I am not an accountant. Whatever you reported to the IRS for 2006 is your current salary. Trying to explain this to the average person would only confused them. Its like explaining per diem when you do contract assignments less than a year. Sometimes I get paid over $20 per hour, when the full time make only $12. But not tax on the first 10, because of driving over 60 miles.one way every day. Sorry about the "flexing" comment. I'm sure you work hard. Sometimes my attempts at humor miss the mark... Paul W.
