confidential infonot sure where to post this question so i'll start here. on what grounds is an employer allowed to release an employees information off their resume that was submitted when they were hired a few years back? or lets go a step further, are employers allowed to release information on performance to other future employers if asked?

The First Amendent guarantees freedom of speech. In other words, there are no laws against an employer saying anything it wants. That said, if you can prove that you were damaged by the statement, and that the statement was untruthful, you have grounds for a claim. If you lied on your resume, you really don't have a leg to stand on. then how likely do you think it would be that new employers request any more information then confirmation of employment, dates, title etc... the basics. from my experience most just confirm the basics. My question though is about the release of records, not a company saying something about an ex employee. Sure the First Amendment is there but can a company release personal records such as performance evals? i didn't put a job on the latest resume b/c i was there for only 6months and left on my own, and its not applicable to my new job, now 2 jobs removed from that 1 job i left off the resume. my belief is as long as the info on the resume is accurate, whatever is left off is not pertinent.
