Terminate with slanderI was terminated from my job and my past employer slander me in front of his employees and to my boyfriend. He made false accusation without any proof. He can search until he is blue in the face and there will be no proof. This is a small company with less than 10 employees. I was told that I was terminated for one reason. Before I even leave, he made this accusation damaging my reputation. I am terribly stressed over this because I do not know how this will affect my future. I didn' t omit this job on my resume because it is directly related to my profession. I work as an accountant and this was an accountant job. My questions are: 1. How do I handle this in future interviews since I included this on my resume? 2. What possible options do I have? I was not going to burn the bridges, but he had already burn it for me. It depends on what he said and not on whether or not he can prove it, but whether he (or any other reasonable person) could BELIEVE it to be true. It also depends on whether there' s any little germ of truth in what he said. So, you' re going to have to give us a bit more detail before we can advise you on this. Immediately consult with an employment lawyer, you can find them in the yellow pages. Either a call from the lawyer or certified letter to have him stop his slander or you will see him in court. Also apply for unemployment, do it today. Unemployment will decide if you get benefits. If it is without cause by their rules you will have benefits. Employer can' t stop benefits without proof. If Unemployment says no, appeal with your lawyer. Employers can' t slander, only if its the truth and only the truth. What you tell other employers is very difficult. I had problem with one employer, where I got unemployment without fighting for it. The Employee Assistant Program (EAP) counselor said to use Laid Off, because of the wrong that the employer did and is well known for only giving dates. Have the lawyer or good friend pretend that he is checking on your reference, record whether it is legal or not. He already said it in front of your boyfriend and fellow coworkers already. That way you know where you stand. He has no legal right to ruin your profession, unless you were found guilty in committing a crime. You need to put this job on your resume, unless it was a short duration. It is related to your profession, telling his side is stupid. Going to court has troubles too and be expensive. A good scare by the attorney is your best option. I hope its not criminal. What a lawyer says to do on how to answer another employer is your best choice, since it is slander. The reason I haven't said anything else on this is I am not sure how exactly to handle it. As I had said before, he can look until he is blue in the face and there is nothing to find because none exist buried or otherwise. I am afraid of even mentioning his companies and location. He had threaten to take away my license. He had already slander me to his outside accountant and in front of his employees. I have every reason to believe he has slander me to other people he knows. Others have stop talking to me altogether. I know I'm no angel. This is one situation that I wish to God none would ever have to encounter. I can say more but he will come after me with a lot more stuffs so that I won't be able to get a job in this city or any other city. Does anyone have this to deal with? You need to at least file for unemployment and consult with an employment attorney. Your not alone, others have been through this also. Even if you did something criminal, unless he has evidence then he should be the one being scarred. A good lawyer can ruin his business overnight, where that bum will be paying many times more than ruining your license. No one will be doing business with or trusts anyone that lies. Even if their the best of friends. He could be loosing his license and business too. Have him investigated, perhaps by the Better Business Bureau or some other organization to dig up dirt on him. A lawyer should know also how to have him investigated. If the supervisor is doing dirt now, he has in the past and has left a paper trail that you as an employee knew nothing about. What comes around goes around. Please talk with a knowledgeable person, it is not the time to be embarrassed, you need support. I have had to use lawyers two different times. One was to used to get the supervisor in trouble the other to fight unemployment. I once reported a COBRA organization to the Department of Labor for fraud, but that's another long story. The best course of action, is not to delay. His damage will be done and he can continue to do as he pleases. Just like in the newspaper when wrong is done. Makes it hard to clear your name once damage is done. Found next to the comics when you are found not guilty, but put on the first page without any facts when being slandered. Unfortunately the BBB doesn't have the power to do anything other than submit paperwork to a company. They cannot shut anyone down, and even if the complaint is not resolved, they will not have the power to make the company do squat. My suggestion would be the state attorneys office, also if there is a board or bureau that regulates that company, go directly to them. Be courteous, don't let your personal feelings come out in the complaint, and make sure your complaint against the company is valid. You may have been fired for one thing, but getting the comapny in trouble by other means is probably your best bet. Do they break any laws? Do they have all the proper coverages (workmans comp. etc) that a company should in your state? Do they conform to business standards as set down by regulatory agencies? These are the things that can cause trouble for companies, and hopefully it will be enough that they won't worry about being on your back anymore. I have been through a similar situation. except i quit. i over herd a rest. manager speak negatively of me while i was in the room and he/she did not realize i was there. i confronted him/her on the spot and told them i didn' t need to work for such a company. since i left the "hell-hole" when i go on interviews, and the employers asks why did i leave. i do not get into to much detail, but i state the obvious, and soon after i respond they say they would not stay either. make sure you keep you confidence high. if you make them think other wise they might think that you were at fault and may be a liability to them. truth be told there were more reason why left as well, so it made my decision easier. most employers see past a minute conflict and may be a great quality in you that they will be glad to have you join there team.. remember, less is more!! good luck Thank you. It is hard to keep up my confident. Up to now I thought noon has gone through what I have. That experience leaves an extremely bad taste in my mouth. I have immigrated to Canada from India approximantely 7.5 years back. In India, I was working as an HR professional in one of the reputed organizations as head of the departmenet for the unit that was employing over 1000 people. I tried to get into the same profession here in Canada too but of no avail. Ultimately, I had to work in retail as sales associate for about 2.5 years and during this time I moved to some other retail organization but I was let go after 5 months. It realy shook me badly both metally and financially. Later I got admission into full time course at the best institution here and finished that with flying colors. I was full of energy and very enthusiastic about my prospects but alas.... I never got any offer of even a single interview from any othe employers I applied to. This led me to undergo a lot of psychological roaster coaster and of course depression. Till now I don't have a job on my hand and I am passing my time with pitty jobs and leading a miserable life ever since. I am wondering if there is any sort of link to my dismissal from the last jobs I had. Are there any hope for me to get back to my own profession again???? I am kind of disoriented. | |
